- The Boating Bay Portal operates solely as an independent platform connecting users with boat rental services. It acts as a middleman facilitating transactions between users and boat rental providers.
- Any boat booked through The Boating Bay Portal does not represent the company nor does it represent any user making use of the services offered by The Boating Bay Platform. The Boating Bay Portal is not the owner or operator of the boats listed on the platform.
8. Limitation of Liability
- The Boating Bay Portal shall not be liable for any indirect, incidental, special, consequential, or punitive damages or injuries, including without limitation, lost profits, data, or goodwill arising from your use of The Boating Bay Portal.
- The Boating Bay Portal shall not be liable for any loss or damage to property belonging to users or third parties arising from the use of The Boating Bay Portal. Users are solely responsible for any property they bring onto vessels or premises accessed through The Boating Bay Portal. The Boating Bay Portal shall not be liable for any theft, loss, damage, injury, or destruction of property, whether caused by negligence, intentional misconduct, or any other cause.
9. Indemnification
- You agree to indemnify, defend, and hold harmless The Boating Bay Portal and its affiliates, officers, directors, employees, agents, developers and licensors from and against any and all claims, liabilities, damages, injuries, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of The Boating Bay Portal or any violation of these terms and conditions.
10. Cancellation & Refund Policy
- Users may cancel their account or subscription with The Boating Bay Portal at any time.
- For subscription-based services, users will continue to have access to the service until the end of the current billing cycle, and no further charges will be incurred.
- No refunds will be provided for any unused portion of a subscription period.
- If a booking is canceled less than 48 hours before the scheduled booking time, the user will forfeit 20% of the booking amount as a cancellation fee.
- If a booking is canceled less than 24 hours before the scheduled booking time, the user will forfeit 40% of the booking amount as a cancellation fee.
- In the event of uncontrollable, unforeseen circumstances like adverse weather conditions leading to cancellation of a booking. Refunds will be considered under certain requirements and not be conducted by default. Refunds will be subject to approval by The Boating Bay Portal and done on the basis of full/partial/no refund. The decision taken by The Boating Bay Portal will be deemed final.
- The Boating Bay Portal reserves the right to cancel or suspend a user's account at any time for violations of these terms and conditions or for any other reason deemed appropriate by The Boating Bay Portal and will be effective immediately.
11. Modifications
- The Boating Bay Portal reserves the right to modify, suspend, or discontinue The Boating Bay Portal at any time without notice.
- The Boating Bay Portal also reserves the right to modify these terms and conditions at any time by posting the revised terms on The Boating Bay Portal. Your continued use of The Boating Bay Portal after such modifications will constitute your acknowledgment of the modified terms and your agreement to abide and be bound by the modified terms.
12. Governing Law and Dispute Resolution
- These terms and conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates.
- Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
13. Severability
